PARTICULARS OF LEASE
TERM
The term of the lease shall be for one year, from November 12th 2002 to November 12th 2003, with option to renew.
INSURANCE
Anna will insure Black Beauty, pay the insurance premiums and receive all insurance money. Anna shall have no right of recovery against Dave.
OUTGOINGS
Except for the costs of Anna's insurance of Black Beauty, Dave shall pay for all outgoings in respect of Black Beauty, including veterinary and farrier charges, feeding costs, transport, and costs of stabling if required in the event of illness or injury.
SOUND HEALTH
Dave shall exercise all reasonable care and skill to ensure that Black Beauty is kept in sound health and condition.
PROMPT NOTIFICATION
Dave shall inform Anna within 24 hours of serious injury or death of Black Beauty.
NO WARRANTY
Anna gives no warranty as to the physical condition or fitness of Black Beauty and Dave acknowledges that he has inspected Black Beauty and that he relies on his own skill and judgement, or a veterinary check at his expense.
BREACH OF AGREEMENT
If either party breaches any term of this lease, the other party may determine this lease upon 24 hours verbal notice to the other, and Anna shall take possession of Black Beauty at the expiry of that notice.
QUIET ENJOYMENT
If Dave performs and observes the terms of the lease, then he shall peaceably hold and enjoy Black Beauty without hindrance or interruption by Anna or by any person or persons claiming under or in trust for Anna until the termination of the lease.
SELLING OR SUB-LEASING
Dave shall not assign, sell or sub-lease Black Beauty without the permission of Anna.
